This is not legal advice
ILR Checker gives general information only. The result you see is an estimate based on your answers and on the Government’s published proposals. It is not a decision about your case and it may be wrong for your circumstances. Do not rely on it to make decisions about your visa or application. Before you apply, speak to a regulated immigration adviser or solicitor, or check the official guidance on GOV.UK.
We are not the Home Office
ILR Checker is an independent website. It is not part of, endorsed by, or connected to the Home Office, UK Visas and Immigration, GOV.UK or any other government body. Only the Home Office can decide an application for indefinite leave to remain.
The rules are not final
The checker is based on A Fairer Pathway to Settlement: Government Response to the Consultation (CP 1707), published in November 2026. At the time of writing:
- the Earned Settlement rules have not come into force and no start date has been announced
- the Government has said it will publish further technical and operational guidance before the rules begin
- some details, including which benefits count as public funds, safeguards for vulnerable groups, the Highest Talent Group and the treatment of Leave Outside the Rules, are still to be confirmed
Applications are normally decided under the Immigration Rules in force on the date of the decision, so the rules that apply to you may differ from those described here. We will try to keep ILR Checker up to date, but we cannot guarantee that it reflects the latest position.
The checker simplifies complex rules
To keep the questions short, the checker groups people into broad categories and makes simplifying assumptions. It cannot take account of every route, exception, exemption, discretion or personal circumstance. Your actual pathway may be different, for example because of absences from the UK, gaps in your visa history, the exact wording of the final rules or how the Home Office uses its discretion.
Where to get advice
For advice on your own situation, use a regulated adviser:
- Find a regulated immigration adviser through the Immigration Advice Authority
- Find an immigration solicitor through the Law Society
- Read the official guidance on GOV.UK
