Family and Private Life and ILR

Family and Private Life permission has its own rules under Earned Settlement. Here is what applies.

Last reviewed 4 November 2026Based on the Government response CP 1707

What is Family and Private Life permission?

This includes people granted permission on the basis of family or private life under Article 8 of the European Convention on Human Rights, including those on the current 10-year partner, parent and private life routes.

Which pathways apply?

Under Earned Settlement, Family and Private Life permission leads to the 10-year or 20-year pathways. It cannot use the 3 or 5-year pathways, even with high earnings.

Requirements

The mandatory requirements still apply: no criminal record, no Government debt, B2 English, the Life in the UK test and the minimum contribution. Public funds in the last 5 years or an adult immigration breach mean 20 years.

Children and young people

Children who have spent 7 years or most of their life in the UK keep their existing 5-year arrangements. See routes outside Earned Settlement.

Questions and answers

Can I switch to a partner route to get 5 years?

If you become the partner of a British citizen and meet the partner route rules, you may have a British connection. Get advice before switching.

Does time already spent on the 10-year route count?

Time on Family and Private Life permission is qualifying time. Detail on how existing time is counted will be in guidance.
